Heard learned counsel for the petitioner and Mr. Shashi Kant Upadhyay, learned Standing Counsel for the State.
By means of this writ petition, the petitioner has prayed for the following relief:-
"(a) issue a direction to the court below to decide the revision no. 268 of 2016 Compt. No. AL-20161128992576 (Narendra Barmecha & others Vs. State of U.P. and others) which is pending before the Board of Revenue U.P., Allahabad under Section 56(1) of Indian Stamp Act, expeditiously within a stipulated period."
It is contended that against the order dated 19.08.2016 passed by the Collector Ghaziabad, the petitioner filed the aforesaid revision before the Board of Revenue, U.P. Allahabad, which is pending since then and only dates are being fixed. Therefore, the petitioner has confined his prayer only for early disposal of the said revision.
On the other hand, learned Standing Counsel very fairly states that in case the aforesaid revision is still pending, the same shall be considered and decided by the authority concerned, expeditiously.
Having regard to the facts and circumstances of the case and the submission made, but without prejudice to the merits of the case, the instant writ petition is finally disposed off with a direction to the authority concerned to make every endeavour to consider and decide the said revision, in accordance with law, expeditiously, preferably within a period of six months from the date of production of a certified copy of this order, if there is no other legal impediment.
