Heard learned counsel for the petitioner and perused the record.
By means of this petition under Article 227 of the Constitution, the petitioner has prayed for following relief:-
"(i) direct the court of Civil Judge (J.D.) Chunar Mirzapur to decide the Original Suit No. 205 of 2016 (Naresh Vs. Vijay Bahadur Singh and others) filed for the permanent injunction against the Respondents No. 1 to 3 pending before it within stipulated period."
After some argument, learned counsel for the petitioner submits that his petition be disposed of directing disposal of pending 6- C application for temporary injunction. He further submits that the defendants- respondents have already appeared in the suit and have not filed written statement till date.
Considering the overall facts and circumstances of the case, this petition is disposed of with a direction to the court concerned to conclude and decide the aforesaid 6-C application strictly in accordance with law and after recording satisfaction regarding service of summons and giving full opportunity of hearing to the appearing parties, as expeditiously as possible preferably within a period of 60 days positively from the date of production of copy of this order.
