JUDGMENT / ORDER

By way of present application, the applicant has prayed to extend the period of temporary bail granted to him for a further period of 30 days on the ground of serious illness of T.B.
Heard Mr.K.I. Kazi, learned counsel for the applicant and Mr.H.L. Jani, learned Additional Public Prosecutor for respondent No.1-State.
Earlier the applicant was released on temporary bail by orders dated 21st October, 2011 and 30th January, 2012. Today also, learned counsel for the applicant states that he is not keeping good health and is required further treatment. He, therefore, prayed to extend the period of temporary bail for a further period of 30 days, which is expiring on 01st April, 2012.
Considering the medical report placed on record by the learned counsel for the applicant, it appears that the applicant is suffering from T.B. and has not recovered yet. The applicant needs special food and treatment. Therefore, I am of the opinion that this is a good case to entertain.
Considering these facts and circumstances, this application is allowed. Period of temporary bail is hereby extended for a further period of 30 days from 01st April, 2012 on usual terms and conditions. The applicant is ordered to surrender himself before the Jail Authority on 01st May, 2012 before 17.00 hours. Rule is made absolutely to the aforesaid extent.
Direct Service is permitted, today.
