JUDGMENT / ORDER

This application is filed by the original accused-convict of Sessions Case No.97 of 2009, who was convicted by learned Additional Sessions Judge, Ahmedabad (Rural) on 05.01.2011 for the offences punishable under Section 363, 366 and 376 of the IPC praying for releasing him on temporary bail for 60 days on the ground that he is suffering from serious illness of T.B. and he was shifted to one hospital to another. The applicant was also released in past on temporary bail by order dated 21.10.2011.
Considering the medical report placed on record by learned APP, the convict prisoner is suffering from serious illness and therefore, he needs special food and treatment. Therefore, I am of the opinion that this is a good case to entertain the application.
Considering these facts and circumstances, this application is partly allowed. The applicant-convict prisoner is ordered to be released on temporary bail for thirty days from the date of his actual release on his furnishing personal bond of Rs.5,000/- before the jail authorities. Direct service is permitted.
Rule is made absolute to the aforesaid extent.
