JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE PARESH UPADHYAY) This application is moved by the convict, who was on temporary bail at the relevant time, for extension of time to surrender before the jail authority.
By the order dated 1.5.2012 of this Court, convict was first asked to surrender before the jail authority, which, it is reported that it is done.
Learned APP, Mr.Pandya, pursuant to the earlier order passed by this Court, has submitted the certificate issued by the Medical Officer, Central Jail Dispensary, Ahmedabad and from the said report, it transpires that the applicant is being provided proper medical treatment and nutritious food.
Under these circumstances, the discretion to permit the applicant to be enlarged on temporary bail does not deserve to be exercised.
At this stage, learned counsel for the applicant seeks permission to withdraw this application.
It is directed to the jail authorities that the applicant - convict shall be provided proper treatment and nutritious food so that his health can be taken care of.
Subject to the aforesaid observation and direction, permission to withdraw the present application is granted. Present application stand dismissed as withdrawn. Rule is discharged.
