(Per : HONOURABLE THE ACTING CHIEF JUSTICE MR.BHASKAR BHATTACHARYA) By this Public Interest Litigation, a prayer has been made for protecting the possession of the existing hutment dwellers of Ambedkarnagar in the District of Surat and to rehabilitate them under JNNURM or under Regulations for the Rehabilitation and Redevelopment of the Slums, 2010 or under any other housing scheme made by the authorities for the urban poor and not to dispossess them without giving alternative accommodation.
In the affidavit submitted by the municipal authority, it has been stated that the municipal authority had made a survey of the families residing in the hutments and registered 129 huts in the Ambedkarnagar and the Corporation had started to issue forms to allot accommodation as per the policy of the Corporation, but the petitioners were not cooperating.
In such circumstances, we dispose of this Public Interest Litigation by directing those hutment dwellers to collect the forms and deposit the same with the municipal authority positively by February 2, 2012. The municipal authority, without considering the application of the persons who would deposit the forms by the aforesaid date, should not take any coercive step for dispossessing them. Before taking any step, fate of such applications or representations should be communicated to the applicants.
With the above direction, this petition is disposed of.
