JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) The present application has been preferred by the applicant - convict for temporary bail on the ground that he wants to divorce his wife.
The learned APP states that the furlough of the applicant - convict had also become due, but since there was no surety, the furlough was not granted.
It appears that when the furlough has become due, the applicant - convict can enjoy furlough and, in any case, furnishing surety is a must. Even otherwise also, unless there is proper surety, He cannot be released even on temporary bail.
Hence, the present application is disposed of with the observation that the applicant - convict shall be at liberty to move the concerned authority for furlough after complying with the requirement of furnishing surety and if such application is made, the concerned authority shall permit the applicant - convict to enjoy furlough in accordance with law.
Disposed of accordingly.
