JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE PARESH UPADHYAY) Rule.
Learned APP, Mr.Pandya, waives service of rule on behalf of respondent-State.
By way of these two applications, the applicants-convicts have prayed that they be enlarged on temporary bail since they want to attend the marriage of their nephew which is scheduled on 25th March, 2012.
In our view, the ground is not such where the presence of the applicants-convicts can be said to be indispensable.
Further, we find that so far the applicant of Criminal Misc. Application No.3769 of 2012 is concerned, he was on furlough leave for the period from 13th January, 2012 to 26th January, 2012 and so far the applicant of Criminal Misc. Application No.3773 of 2012 is concerned, he was on furlough leave in October - November, 2011.
Considering the totality of the facts, discretion does not deserve to be exercised in these cases.
Hence, the applications are rejected. Rule discharged.
