JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE PARESH UPADHYAY) Rule.
Learned APP, Mr.Pandya, waives service of rule on behalf of respondent-State.
By way of this application, the applicant-convict has prayed that he be enlarged on temporary bail to attend the post death rites of his mother.
Along with the application, the death certificate of the mother is annexed and from jail remarks, we find that earlier, the applicant was enlarged on temporary bail and on furlough leave and he has surrendered to the jail authorities in time.
Considering the totality of the facts, it is ordered that applicant-convict shall be enlarged on temporary bail for a period of 10 days from the date of his actual release on personal bond of Rs.5,000/- with one surety of like amount and with the further direction that he shall surrender to the jail authority on expiry of the period granted by this Court.
Application allowed to the aforesaid extent. Rule made absolute.
