Mr.
Mishra, learned advocate for the opponent - original petitioner (employer), has submitted that in view of the order dated 28.11.2011 and in compliance thereof, the employer will, within 10 days from today, pay all the wages payable under Section 17(B) of the Act, to the applicant - original respondent (workman).
In view of the said statement made by Mr. Mishra, learned advocate for the opponent, Mr. Gohil, learned advocate for the applicant, relying on the said statement of Mr. Mishra, seeks permission to withdraw present application.
In view of the said statement made by Mr. Mishra, learned advocate for the opponent, the opponent herein is directed to make payment to the workman in compliance of the aforesaid order dated 28.11.2011, within 10 days from today.
With the aforesaid direction, the application stands disposed of as withdrawn in view of the permission sought for by Mr. Gohil, learned advocate for the applicant.
