1. Shri Mukul Sinha, learned counsel for the petitioners has invited this Court s attention to the averments and submissions made by way of pleading and averments in the petition, specifically paragraph 4.1. Let there be a Notice on urgent bases returnable on 11th March, 2013.
2. Meanwhile, status-quo as on date qua the recruitment procedure be maintained by the respondents. This status-quo order is required to be passed as the Court is mindful that on earlier occasion when there was a challenge to the recruitment procedure qua advertisement dated 04/09/2012 was being considered, the Court may order specifically observing that the selectees pursuant to that advertisement and recruitment procedure would be governed by final outcome of the petition being S.C.A. No.16706 of 2012 and the Division Bench, which was moved by L.P.A. No.34 of 2013, challenging the order did not disturb the same. However, the same should not work as an impediment in work of this Court in granting specific stay of status-quo as the peculiar facts of this case requires staying of the recruitment procedure as the subsequent advertisement, which is subject matter of challenge in this petition do not contain any explanation whatsoever qua what has happened to the recruitment procedure undertaken earlier. This blissful silence and no explanation or indication in the subsequent advertisement and offering the candidates to offer once again their candidature, who were examinees or candidates in the earlier recruitment procedure pursuant to advertisement dated 04/09/2012 are also permitted to offer their candidature, which in turn would amount to leaving them in darkness as to what happened to their selection procedure, because the written test was also conducted and the results were awaited at the stage when the Court has passed earlier order.
