Heard Sri A.K. Srivastava, learned counsel for the applicants and Sri I.P. Srivastava, learned A.G.A. for the State.
This application under Section 482 Cr.P.C. has been filed for quashing the order dated 20.2.2007 issuing non bailable warrant against the applicant in case no. 6056 of 2015 arising out of case crime no. 98 of 1998 under section 25 Arms Act, police station Medical, District Meerut.
Learned counsel for the applicant submits that though the applicant has appeared before the court concerned till the year 2006 but as his lawyer misinformed him he could not appear before the court on account of which non bailable warrant has been issued against the applicant, hence the same is liable to be quashed.
Learned A.G.A. opposed the prayer for quashing and submitted that non bailable warrant has been issued against the applicant in the year 2007 but till date the applicant has not surrendered before the court concerned and has come up to this Court challenging the same.
After having heard the learned counsel for the parties present and perused the impugned order as well as the material brought on record, I am of the view that the impugned order is illegality, infirmity or jurisdictional error, hence requires no interference by this Court in its inherent power under Section 482 Cr.P.C.
The application lacks merits and is accordingly dismissed.
