Heard Sri Rajendra Kumar Yadav, learned counsel for the petitioner and learned standing counsel.
The case of the petitioner is that despite obtaining an order dated 23.10.2018 from RERA directing the respondent no. 4 to deposit the due amount thereunder within 30 days along with interest and issuance of recovery certificate dated 07.02.2019 by the District Magistrate, Gautam Budh Nagar till date no recovery whatsoever has been effected.
Learned Standing counsel submits that no purpose would be served by keeping this petition pending it be disposed of by giving appropriate direction to the authority concerned.
The writ petition is disposed of with a direction that in the event the petitioner approaches respondent no. 3 along with a copy of this order, the District Magistrate, Gautam Budh Nagar shall ensure that the recovery proceeding be concluded as expeditiously as possible.
Compliance report be submitted before us in chambers on 17.03.2021 at 4.00 p.m.
