We have perused the record as well as the order of the learned Single Judge. The petitioner/appellant is virtually a rip van winkle. He has opened up after many years. Learned Single Judge has rightly held that the litigant is required to be vigilant over his rights and not to sleep over his rights for such a long period.
We are not inclined to interfere in the order passed by the learned Single Judge.
The Special Appeal is dismissed. No costs.
