1. Heard learned counsel for petitioner and learned Standing Counsel as well as Sri Manu Saxena, Advocate for respondents.
2. This is a dispute between petitioner and private person, i.e., respondent no. 5, alleging that he has encroached upon land belong to Nagar Palika Parishad.
3. Learned counsel for petitioner, when questioned, could not dispute that petitioner has alternative remedy under the provisions of Code of Criminal Procedure as well as under the provisions of U.P. Municipalities Act, 1916. Hence, writ petition is dismissed on the ground of alternative remedy.
