By way of this petition under Art. 226 of the Constitution of India, the petitioner has prayed for the following reliefs:
(A) Your Lordships may be pleased to issue appropriate writ direction or order directing the respondent Corporation to grant the petitioner full pension in view of the fact that he had services of more than 33 years with the respondent Corporation.
(B) Be pleased to direct the respondent to treat the petitioner as permanent wireman w.e.f. 1-1-1968 and to confer upon him benefit of higher grade pay scale from 1-1-1968 i.e. the date from which it is certified that he was working as wireman by the authorities and fix his pay and pension accordingly and payment of consequential difference of pension and pay, with interest at the rate of 12% p.a. (C) Be pleased to direct the respondent Corporation to redress the grievance of the petitioner regarding payment of lower pay scale as set out in para 3(2) and 3(3) and consequent refixation of his pay and pension accordingly and to make payment with interest.
(D) Be pleased to allow this petition with costs and to quantify the costs.
(E) Be pleased to grant such other and further reliefs as may be deemed just and proper by the Hon'ble Court in the facts and circumstances of the case."
Mr.
Sharma, learned counsel appearing for the petitioner at the out set submits that instead of pursuing the present matter on merits, petitioner would opt for filing representation for reconsideration of the order dated 16/3/2010 (Annexure - G) to this petition.
The petitioner is permitted to file representation raising all grounds, which are available before respondent authority. The respondent authority shall consider the same in accordance with law as expeditiously as possible.
With these observations, the petition is disposed of with no order as to costs. Notice discharged.
