JUDGMENT / ORDER

The petitioners herein are the two accused in C.C No.682 of 2013 of the Judicial First Class Magistrate Court – II, Perinthalmanna. Crime in the said case was registered under Sections 341, 323 and 324 IPC on the complaint of one Shaji who is the second respondent herein. Now the accused seek orders under Section 482 Cr.P.C quashing the prosecution on the ground that they and the complainant have settled the dispute amicably. The second respondent has filed affidavit to the effect that he has settled the dispute with the accused, and that he has no grievance or complaint now. I find that the parties have really settled the dispute, and that continuance of prosecution in such a situation will not serve any purpose, other than wasting the precious time of the court. No doubt, the material witnesses will not support the prosecution in case C.C No.682 /2013 goes to trial. In the result, this petition is allowed. The prosecution as against the petitioners in C.C 682/2013 of the Judicial First Class Magistrate Court, Perinthalmanna will stand quashed under Section Crl. M.C No. 5976 of 2014 2 482 Cr.P.C, and the petitioners will stand released from prosecution. The bail bond, if any, executed by the petitioners will stand discharged.
