THIS WRIT PETITION COMING ON FOR PRELIMINARY HEARING IN ‘B’ GROUP THIS DAY, THE COURT MADE THE FOLLOWING:-
ORDER 2. In this petition, the petitioner is seeking for a writ of mandamus directing the respondent No.2 to forward the enquiry report dated 28.06.2017 submitted by respondent No.3 vide Annexure-N to respondent No.1 for appointment of the administrator.
3. When the matter was taken up today, learned counsel for the petitioner submitted that he be granted with a liberty to make a fresh representation before the competent authority. On the other hand, learned counsel for respondents submitted that if such a representation is made by the petitioner the same shall be dealt with in accordance with law.
3. In view of the submissions made and in the facts of the case, the writ petition is disposed of with a liberty to the petitioner that in case a representation with regard to the grievance raised in the petition is made to the competent authority, the same shall be decided by the competent authority by a speaking order within a period of four months from the date of receipt of such a representation. It is made clear that this Court has not expressed any opinion on the merits of the case.
Accordingly, the petition is disposed of.
