This application u/s 482 Cr.P.C. has been filed seeking the quashing of impugned order dated 04.07.2017 passed by Principal Judge, Family Court, Auraiya in maintenance Case No. 190 of 2016 (Smt. Roli @ Rajkumari Vs. Narayan Singh) as well as Case No.90 of 2019 (Smt. Roli @ Rajkumari Vs. Narayan Singh) by recovery warrant dated 05.08.2019 passed by Principal Judge Family Court, Auraiya, under Section 125 Cr.P.C., Police Station Sahayal, District Auraiya.
Heard applicant's counsel and learned AGA. Entire record has been perused.
The only submission made by the applicant's counsel is that the applicant wants to make payment of the amount as directed by the Court below but some easy installments may be made as it is beyond the purse of the applicant to make the whole payment at a stretch. A direction in this regard has been sought by the counsel.
Such kind of prayer as has been made by the counsel may be placed before the court concerned and he may move an appropriate application before the court below making the same prayer. If any such application is made before the court below within 20 days from today, the court below will look into the same and will pass appropriate orders as it may deem fit in accordance with law. If the court below deems it proper to make some convenient installments it shall be allowed to do so on the strength of the direction issued by this Court in exercise of its inherent jurisdiction.
With the aforesaid observations this application stands disposed off.
