Heard learned counsel for the applicants, learned AGA for the State and perused the record.
This bail application has been filed by the applicants Narayan Singh and Sukhbir Singh seeking bail in Case Crime No. 386 of 2018, under Sections 147, 148, 323, 307, 308, 325, 452, 504, 506 IPC, Police Station Shergarh, District Mathura.
Learned counsel for the applicants has submitted that the applicants are wholly innocent and have been falsely implicated in the present case due to ulterior motive.
Learned counsel for the applicants has next submitted that as per the allegations made in the FIR, as many as six persons are said to have assaulted the victims, due to which, three persons, namely, Sonu, Mahendra Singh and Vishnu have suffered injuries.
Perusal of the injury report of Sonu shows that he suffered as many as 8 injuries on his person, whereas Mahendra Singh has suffered as many as two injuries and other injured Vishnu has suffered complaint of pain and swelling over half forearm middle and lower 1/3. The supplementary injury report shows that Mahendra Singh has suffered fracture of parietal bone and the injuries of the victims have been found to be grievous in nature and dangerous to life, whereas as per the X-Ray report of Vishnu, he suffered fracture of radius and ulna bone and his injuries are found to be grievous in nature. As per the statement of the victim Mahendra Singh and Vishnu, specific role of assaulting the victims have been assigned to the applicants and the injuries have been found to be grievous in nature and also dangerous to life.
Keeping in view the specific allegations made against the applicants and role assigned to them and looking to the seriousness of the offence and severity of punishment, I do not find it is a fit case for bail. The bail application is accordingly rejected.
