ORDER:
This contempt case is filed alleging wilful disobedience of order dated 29.04.2013 in W.P.M.P.No.26542 of 2012 in W.P.No.20699 of 2012.
By the above-mentioned order, this Court has declined interim relief claimed by the petitioner for a direction to the respondent to pay the sale consideration amount of Rs.13.65 lakhs with interest at the rate of 10% per annum. However, liberty was given to the petitioner to receive the sum of Rs.13.65 lakhs without interest, as offered by the respondent in his letter dated 01.06.2012, without prejudice to the petitioner’s right to pursue the writ petition for payment of interest.
From this interim order, it is clear that no direction was given to the respondent to pay the sum of Rs.13.65 lakhs. In the absence of such a direction, non-payment of the said sum by the respondent does not constitute contempt.
Hence, the contempt case is dismissed.
