JUDGMENT / ORDER

Hon'ble Vivek Kumar Birla,J.
Heard learned counsel for the petitioners and Sri Prakash Padia, learned counsel for the respondent Corporation.
Impleadment application filed by Gagan Gangwar through Sri V.K. Tiwari, Advocate is allowed.
Let him be impleaded in the array of parties as respondent No.5.
Sri Ramesh Kumar Mishra, learned counsel for the petitioners submits that the manner in which the petitioners have been non-suited clearly indicates the perversity on the part of the respondents, inasmuch as, the petitioners had filed all documents as per Annexure-2 to the writ petition and the index indicated therein the same including the site plan prepared by Lekhpal in relation to the land offered by the petitioners and also a sale deed in support thereof.
Learned counsel submits that admittedly erroneous considerations have been made and it is for this reason that the matter had been sent for re-evaluation. The re-evaluation and the subsequent consideration does not appear to reflect the correct facts.
Let all the respondents file counter affidavit within three weeks.
List thereafter.
Any allotment made in this period shall be subject to the outcome of the writ petition.
