ORDER:
This Civil Revision Petition is filed against order dated 3-10-2013 in I.A.No.487 of 2013 in O.S.No.1157 of 2009 on the file of the learned II Additional Junior Civil Judge, Ranga Reddy District.
The petitioner has filed the above mentioned application for his impleadment in the suit filed by respondent Nos.1 to 3 for specific performance of agreement of sale against respondent Nos.4 and 5. The lower Court has dismissed the said application on the ground that the petitioner has previously filed I.A.No.1225 of 2010 which was dismissed on 11-3-2013 and the said order was confirmed by this Court in C.R.P.No.1882 of 2013.
In my opinion, the lower Court has rightly dismissed the application as the petitioner cannot maintain successive applications for the same relief. Even if the previous application was dismissed for non-filing of documents, the petitioner cannot maintain a second application unless he has obtained leave either from the trial Court or at least from this Court in C.R.P.No.1882 of 2013. In this view of the matter, I do not find any jurisdictional error warranting interference with the order of the lower Court.
The Civil Revision Petition is accordingly dismissed.
As a sequel to the dismissal of the Civil Revision Petition, CRPMP No.1955 of 2014 filed for interim relief is disposed of as infructuous.
