1. Heard Sri Raj Narayan Tiwari, learned counsel for appellant and Sri A.K. Sinha, learned counsel for respondents and perused the record.
2. This appeal has been preferred by the owner against the judgment and award dated 22.01.2008 and the decree dated 30.01.2008 passed by Motor Accident Claims Tribunal/Additional District Judge, Room No.2, Allahabad (hereinafter referred to as 'Tribunal') in M.A.C.P. No. 700 of 2001 awarding a sum of Rs.52,000/- with interest at the rate of 6% as compensation to the claimant.
3. It is submitted by Sri Raj Narayan Tiwari, learned counsel for appellant that certain amount have already been paid by the owner to Bhagirathi claimant-respondent. Today amount of Rs.30,000/- in the kind of demand draft be paid to claimant which is accepted by Sri A.K. Sinha, Advocate on behalf of original claimant before this Court.
4. The appeal is partly allowed to the aforesaid extent. The record and proceedings be sent back to the Tribunal. Interim relief if any shall stands vacated.
5. This Court is thankful to both the Advocates for getting very old matter disposed of.
