Nanubhai vs The

High Court Of Gujarat|26 March, 2012

JUDGMENT / ORDER

Present Civil Application under Section 5 of the Limitation Act has been preferred by the applicants herein - original petitioners to condone the delay of 575 days caused in preferring the Civil Revision Application.
Shri N.A. Pandya, learned advocate appearing on behalf of the contesting respondent has tried to oppose the present civil application by submitting that no sufficient cause has been shown. However, considering paragraph 4(A) of the application (as amended) and so as to give one additional opportunity to the applicant rather than non-suiting him on technical ground of delay, present application is allowed and the delay caused in preferring the Civil Revision Application is hereby condoned. Rule is made absolute accordingly.
Registry is directed to notify Main Civil Revision Application for admission hearing on 28th March 2012.
