Heard Shyam Sunder Mishra, learned counsel for the applicants and learned AGA for the State.
This 482 Cr.P.C. application has been filed with a prayer to quash the entire proceedings of Criminal Case No.449 of 2018 (State Vs. Kripashankar and others), arising out of Case Case Crime No. 247 of 2016, under Sections 323, 504, 452, 354-B, 506, 147 IPC, Police Station Husainganj, District Fatehpur, pending in the court of learned Additional Chief Judicial Magistrate, Court No.11, Fatehpur as well as charge sheet dated 18.10.2016.
Learned counsel for the applicants submits that applicants are the wives of the applicants of Application U/S 482 No. - 28236 of 2018, who have already been granted interim protection by this Court vide order dated 16.8.2018 and, as such, same treatment be accorded to them also. It is further submitted that the opposite party no.2 had lodged a false prosecution against the applicants for their malicious prosecution.
Notice on behalf of opposite party no. 1 has been accepted by learned A.G.A.
Issue notice to opposite party no.2 returnable within four weeks at the address given in the application.
Opposite party no.2 may file counter affidavit within four weeks. Learned A.G.A. may also file counter affidavit within the same period. Rejoinder affidavit may thereafter be filed within two weeks.
List thereafter.
Till the next date of listing, further proceedings of the aforesaid case shall remain stayed.
