This anticipatory bail application has been moved on behalf of Nankey Yadav involved in Crime No. 106 of 2018, under Sections 419, 420, 467, 468, 471, 323 and 506 I.P.C., Police Station Bhinga, District Shrawasti.
Heard learned counsel for the applicant and learned A.G.A. for the State.
It is submitted by learned counsel for the applicant that date of birth of the applicant mentioned in the certificate was found correct, according to report dated 23.03.2018 submitted by Inquiry Officer. The applicant is a poor person and he applied for the post of Sweeper in the institution, believing his educational certificate as genuine. He was not having any intention to deceit the institution. There is possibility of his arrest, therefore, anticipatory bail be granted to him.
Learned A.G.A. has opposed this anticipatory bail by submitting that the applicant applied for post of Sweeper in the institution on the basis of mark-sheet of Class VIII, claiming him to be declared passed from Junior High School, Balha, District Bahraich and Transfer Certificate was also annexed with the application. The Inquiry Officer found that mark-sheet of year 1998 was prepared forged, because the aforesaid institution was not running in the year 1998.
In the aforesaid circumstances, no case for granting anticipatory bail is made out.
Accordingly, rejected.
