Learned advocate for the applicant submits that, for the incidents of 1992, the complaint was lodged in the year 2009 and the power of attorney, original accused, had executed registered sale deeds in favour of different persons as per the chart produced at page 4 of the petition. However, the applicant is named by the said power of attorney alleging that the power of attorney was executed at his behest.
In the above circumstances, a case is made out to issue notice.
Issue notice returnable on 2.3.2012.
Learned APP waives service on behalf of the State.
Respondent No.2 be served through speed-post or courier at the cost of the applicant.
