The prayer in the writ petition is for a Writ of Mandamus directing the respondents 1 and 2 to consider the representation dated 09.10.2012, and thereby direct the respondents to disburse all monetary benefits of the petitioner brother, by name, Late Ramalingam, in favour of the petitioner, within a stipulated time.
2. Heard both sides.
3. Learned counsel appearing for the petitioner submits that since the prayer in the writ petition itself is only to consider and dispose of the representation given by the petitioner, the same can be considered.
4. Learned counsel appearing for the respondents would also submit that the representation of the petitioner would be considered by the first respondent in a given time on merits and in accordance with law.
5. Considering the said submissions made by the learned counsel appearing for the petitioner, this Court is inclined to dispose of this writ petition with a direction to the first respondent to consider the representation of the petitioner dated 09.10.2012, on merits and in accordance with law and pass orders thereon within a period of three weeks from the date of receipt of a copy of this order.
6. The petitioner shall send a copy of the said representation to the first respondent, immediately, on receipt of the copy of the order, and thereafter, the needful, as indicated above, shall be done by the first respondent within three weeks.
7. Consequently, connected miscellaneous petition is closed. However, there shall be no orders as to costs.
