Heard learned counsel for the parties.
On 14.12.2018, similar FIRST APPEAL No. - 708 of 2008 arising on the same acquisition, was partly allowed following the Division Bench judgment in FIRST APPEAL No.
- 1062 of 1995 (Bishambhar Singh & others Vs. State Of U.P) on 16.11.2016. In the case of Bishambhar Singh & others (supra) the appeals were partly allowed determining the compensation @ Rs.120/- per sq. yard alongwith other statutory benefits and interest. A joint statement was made by learned counsels for the parties that the appeal may be partly allowed in terms of the aforesaid judgment in the case of Bishambhar Singh & others (supra).
In view of the aforesaid, this appeal is also partly allowed in terms of the aforesaid Division Bench Judgement.
