Heard Shri Jai Prakash Singh, learned counsel for petitioner and learned A.G.A. for State of Uttar Pradesh.
This writ petition has been filed for issuing of mandamus directing the respondent nos. 2 and 3 i.e. Senior Superintendent of Police, Shahjahanpur and Station House Officer, Police Station- Ram Chandra Mission, District-Shahjahanpur to ensure the fair and impartial investigation in pursuance of F.I.R. dated 16.01.2019 registered as Case Crime No. 19 of 2019, under Sections 147, 302 I.P.C., Police Station- Ram Chandra Mission, District-Shahjahanpur.
It is stated that F.I.R. was lodged on 16.01.2019 but police is not proceeding in the matter.
In the facts of present case, writ petition is disposed of with the direction to respondent nos. 2 and 3 i.e. Senior Superintendent of Police, Shahjahanpur and Station House Officer, Police Station- Ram Chandra Mission, District-Shahjahanpur to ensure the fair and proper investigation in pursuance of F.I.R. dated 16.01.2019 registered as Case Crime No. 19 of 2019, under Sections 147, 302 I.P.C., Police Station- Ram Chandra Mission, District-Shahjahanpur and submission of report by Investigating Officer under Section 173(2) Cr.P.C. as early as possible.
