Supplementary affidavit filed today is taken on record.
By means of the present petition, the petitioners are seeking quashing of the first information report dated 03.09.2021 registered as case crime no. 276 of 2021, under sections 366 I.P.C., police station Bhuta District Bareilly.
It is stated that both the petitioners herein have solemnized their marriage on 3.9.2021. The first information report has been lodged because the respondent / the complainant, the father of the petitioner no. 1, is against their marriage.
It is stated by the learned counsel for the petitioners that the petitioners have presented an application for registration of their marriage before the competent Registrar and the same has been registered on 10.9.2021. It is further submitted that the statement in the first information report of enticing away the victim by the petitioner no. 2 is false.
Considering the material on record and the averments in the first information report, we only provide that the petitioners shall not be arrested during the course of investigation. The Investigating Officer shall, however, be under obligation to conclude the investigation by following the strict procedure of law preferably within a period of three weeks from today.
The writ petition is accordingly, disposed of.
