Heard learned counsel for the petitioner.
By means of this petition under Article 227 of the Constitution, the petitioner, who is defendant in the suit, has prayed for following relief as substantial relief:
"(i) direct the A.C.J. (J.D.) Court No. 20, Allahabad (Now Prayagraj) to consider and decide the exparte injunction granted by court below on merits after hearing the parties, expeditiously, within a specified period of time, as this Hon'ble Court may fix which is pending since 2017."
It is submitted by learned counsel for the petitioner that he has already moved an application for vacating the order of temporary injunction granted by trial court in an ex parte manner and yet the application has not been heard.
I find substance in the argument of learned counsel for the petitioner.
Let the application for vacating the order of temporary injunction be heard quite expeditiously and be disposed of within a period of six weeks.
With the aforesaid direction, this petition is disposed of.
