Hon'ble Saurabh Shyam Shamshery,J.
1. Sri Vinay Kumar Mishra, learned counsel for petitioners, fairly submits that petitioners have not filed any proper application before the District Magistrate concerned in Case No. 0202/03440000236, under Section 30 of U.P. Land Revenue Act, 1901, to bring on record that the status quo order dated 12.03.2021 passed therein is violated by private respondents. He seeks liberty to approach the District Magistrate concerned by way of filing an appropriate application. He further prayed that prayers made in this writ petition be treated to be not pressed and appropriate order be passed for expeditious disposal of application.
2. Learned Standing Counsel appearing for State-Respondents has no objection if the aforesaid prayer is allowed.
3. In view of above, without expressing any opinion on the merits of the issue and considering the facts and circumstances of the case, this writ petition is disposed of finally with liberty to petitioners to file appropriate application before Competent Authority within three weeks from today and in case such an application is filed by petitioners, the Competent Authority is directed to decide the same after hearing all concerned parties in accordance with law expeditiously.
