Heard Sri S.N. Pandey, learned counsel for the petitioner, Sri S.P.Singh, learned A.G.A. appearing for the State and perused the impugned F.I.R. as well as material brought on record.
The relief sought in this petition is for quashing of the F.I.R. dated 24.3.2021, registered as Case Crime No.112 of 2021, under Sections 419, 420, 467, 468, 471, 269, 272 I.P.C. and Sections 60, 63 & 72 Excise Act, Police Station Amethi, District Amethi.
Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R., his name has come into light in the confessional statement of the co-accused who was arrested on the spot and the petitioner is said to have fled away from the place of occurrence. He further submits that the involvement of the petitioner has been deliberately shown in the present case just to malign his image in the society and to devoid him from contesting the Panchayat Election which is going to be held very shortly by the rival political parties as he is contesting the election as a Congress Party candidate and also to prevent him from filing his nomination. The petitioner has been falsely implicated in the present case due to ulterior motive. No incriminating article has been recovered from the possession of the petitioner. No offence is made made out against the petitioner, hence, the F.I.R. is liable to be quashed.
Learned AGA opposed the prayer for quashing of the FIR which discloses cognizable offence.
After having examined the submissions advanced by learned counsel for the parties and perused the impugned FIR, we are of the opinion that the impugned FIR discloses cognizable offence against the petitioner, hence, no interference is called for by this Court in its extraordinary power under Article 226 of the Constitution of India for quashing of the FIR or for grant of any interim relief to the petitioner.
The petition lacks merit and is, accordingly, dismissed.
