This Criminal Misc. Application under Section 482 Cr.P.C. has been filed with the prayer to direct the court below to dispose off the bail application of the applicant on same day, when they surrender and apply for bail with case crime no. 1058 of 2009, under Sections 382, 411/34 IPC, P.S. Nanhara, District-Ghazipur.
Heard learned counsel for the applicant and learned A.G.A. and perused the record.
Learned counsel for the applicant submitted that the prayer is for consideration of the bail application, expeditiously, on the same day. In view of the fact of the present case, it is provided that if applicant appears and surrenders before the court below and apply for bail within three weeks from today, then the prayer for bail shall be considered, as expeditiously as possible in accordance with law, in view of the law laid down by the Full Bench of this Court in the case of Amrawati and another Vs. State of U.P. reported in 2004(57) ALR 390 and affirmed by Hon. Apex Court in Lal Kamlendra Pratap Singh Vs. State of U.P. and others 2009(2) Crime 4 SC after affording the opportunity to the public prosecutor.
