The petitioner claims to be a Bhumidhar of arazi no. 493 area about 0.0270 hectare, arazi no. 31/4 area about 0.02908 hectare arazi no. 114/3 area about 0.118 hectre and arazi no. 491/23 area about 0.04520 hectare total area about 0.21928 situated in Village Dodasar, Paragana, Pachottar, Tehsil Sasimabad, District Ghazipur. The petitioner executed a sale deed in favour of the Nodal Officer, Purvanchal Express Way Authority on 12.02.2018 for consideration amount of Rs. 70,16,960/-. But the grievance of the petitioner is that till date the consideration amount has not been paid in spite of clause being given in the sale deed that the amount will be credited in the account of the petitioner within 15 days.
Learned counsel for the petitioner submits that the Competent Authority in this regard is the Collector, Ghazipur, respondent no. 3.
In our opinion, no useful purpose would be served for keeping this writ petition pending, as direction is being issued to the respondent no. 3 to consider the claim of the petitioner with regard to sale consideration as per the sale deed dated 12.02.2018 and pass appropriate orders in accordance with law as far as possible within one month from the date of certified copy of this order is presented before the Collector, Ghazipur.
