It is not in dispute that some of the respondents inclusive of the original plaintiff has expired and even as per the earlier order, the present Appeal is ordered to be abated qua respondent Nos.1 (original plaintiff), 2, 3 and 13.

Under the circumstances, when the Appeal qua original plaintiff itself is ordered to be abated, the present Second Appeal is dismissed as having been abated as a whole. No costs.
