In this case, appellant Nanda is said to be died.

In this regard, a report from Chief Judicial Magistrate, Fatehpur dated 13.01.2021, is on record which is as per circular issued by this Court, stating therein that sole appellant died, hence the appeal stands abated.

Accordingly, the appeal is dismissed as abated.
