Heard learned counsel for the applicant and learned A.G.A. for the State.
The present application has been filed for quashing the summoning order dated 20.11.2018 as well as entire proceeding of the complaint Case No. 2855 of 2917 (Mool Chand Chauhan Versus Nandu Chauhan), under Sections 406,504,506 I.P.C., Police station Sahabganj, District Chanduli, which is pending in the court of Judicial Magistrate Chakia, District Chandauli.
It is submitted by the learned counsel for the applicant that no offence against him is made out and the summoning order has been passed in order to harass the applicant. He pointed out certain documents and statements in support of his contention.
Learned A.G.A has accepted notice on behalf of the opposite party no.1.
Issue notice to opposite party no.2 returnable within four weeks at the address given in the application.
Steps be taken within one week.
Opposite parties may file their counter affidavit within four weeks. Rejoinder affidavit may be filed within two weeks thereafter.
List thereafter.
Until further orders of this court, entire proceedings of the aforesaid case shall remain stayed against the applicant.
