Heard learned advocate for the applicant.
2. By way of present application, the applicant seeks deletion/modification of condition No.7(iii) of the order dated 16.08.2010 passed in Criminal Miscellaneous Application No.9051 of 2010. Condition No.7(iii) reads as under:
"[iii] not leave the local limits of State of Gujarat without the prior permission of the concerned Court."
3. Learned advocate for the applicant submits that the applicant is resident of Rajasthan and is having his ancestral home at the town of Danalpur at Karaulli district. It is further submitted that the father and mother of the applicant are over 70 years old and constantly require medical attention. It is further submitted that considering the facts and circumstances of the case, the condition as prayed for, may be modified.
5. Heard learned APP for the respondent - State of Gujarat.
6. Having heard learned advocate for the applicant and learned APP and considering the overall facts and circumstances of the case, I am inclined to allow this application. Accordingly, condition of not leave local limits of State of Gujarat is modified to the extent that, "not to leave India without the prior permission of the concerned Court."
Rest of the conditions of the bail order shall remain as they are.
Rule is made absolute to the aforesaid extent only.
Direct service is permitted.
