Heard learned counsel for the applicant, learned A.G.A. and perused the F.I.R. and other relevant papers filed in support of the bail application.
The submission of learned counsel for the applicant is that the co-accused Ajeet Kumar Singh has already been granted bail by this Court vide Crl. Misc. Case No.8312(B) of 2009 dated 3.12.2009.
It is further submitted that the case of the present applicant is similar to that of co-accused Ajeet Kumar Singh. The other co-accused have also been granted bail by this Court. Learned counsel for the applicant claims parity which is not controverted by the State counsel. The applicant is in jail since 26.10.2009, as averred in para 2 of the bail application and has no previous criminal history, as mentioned in para 7 of the bail application.
Considering the overall aspects of the matter and without entering into the merit of the case, I hereby provide that the applicant, Nandoo @ Nand Kumar @ Pappu Singh be released on bail in Case Crime No.1171/2009, under Sections 420, 468, 471, 474 I.P.C., P.S. Hazratganj, District Lucknow, on his filing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned/remand magistrate.
