CITY CIVIL SESSIONS JUDGE, BENGALURU ON I.A.NO.15 FILED UNDER ORDER XXI RULE 19 OF THE CIVIL PROCEDURE CODE, IN FDP NO.150/2013 (VIDE ANNEXURE-A HEREIN), AND CONSEQUENTLY ALLOW THE SAID I.A.NO.15 FILED BY THE PETITIONER.
THIS WRIT PETITION COMING ON FOR PRELIMINARY HEARING THIS DAY, THE COURT MADE THE FOLLOWING:-
O R D E R Sri K.S. Uday, on taking notice to the Respondent NO.1 submits that the impugned order passed by the trial Court dated 31.1.2019 on I.A. No.15 is appealable before the Appellate Authority under the provisions of Order 43 Rule 1-A of the Code of Civil Procedure.
2. The same is not disputed by the learned counsel for the petitioner.
3. In view of the above, the writ petition is disposed of as not maintainable with liberty to the petitioner to avail the alternative remedy, in accordance with law.
4. Office is directed to return the certified copy of the impugned order to the learned counsel for the petitioner forthwith.
