ORDER:
This writ petition is filed for the following substantive relief:
“…to issue a Writ of Mandamus or any other appropriate Writ or Writs, Order or Direction, declaring the action of 2nd Respondent in not assigning priority to the petitioner on the basis of sports certificates submitted by him, duly verified and authenticated by 5th Respondent, as illegal, arbitrary and without jurisdiction and to consequently direct the 2nd Respondent to forthwith assign priority to the petitioner on the basis of sports certificates submitted by him, duly verified and authenticated by 5th Respondent, for the purpose of securing admission into MBBS/BDS Course in 3rd Respondent University, under sports quota, for the academic year 2014-15; Award costs.”
At the hearing, it is not disputed that the entire admission process into the MBBS and BDS Courses has been completed and classes have already been commenced long back.
In view of the same, the relief claimed in this writ petition cannot be granted. However, this order will not preclude the petitioner from availing appropriate remedy for damages against such of those respondents who according to the petitioner are responsible for allegedly denying him the valuable seat.
Subject to the liberty given as above, the writ petition is dismissed.
As a sequel to dismissal of the writ petition, W.P.M.P.No.37299 of 2014 shall stand disposed of as infructuous.
