ORDER:
This Writ Petition is filed to declare the action of the respondents in not supplying essential commodities to the petitioner’s fair price shop bearing No.28 of Nagandla village, Inkollu Mandal, Prakasam District, as illegal and arbitrary.
At the hearing, the learned Assistant Government Pleader for Civil Supplies (AP), on instructions, submitted that on 8-10-2014, respondent No.2 has suspended the petitioner’s fair price shop authorisation while issuing a separate show cause notice on the same day. The learned Counsel for the petitioner stated that his client has not received the said order. However, the learned Assistant Government Pleader has furnished a copy of the same to the learned Counsel for the petitioner at the hearing.
Inasmuch as the petitioner’s authorisation has been suspended, the premise on which the Writ Petition is filed has turned out to be incorrect. Hence, the Writ Petition is dismissed with liberty to the petitioner to avail appropriate remedy for questioning the suspension order, if she feels aggrieved thereby.
As a sequel to the dismissal of the Writ Petition, WPMP No.41817 of 2014 filed for interim relief is disposed of as infructuous.
