JUDGMENT / ORDER

The petitioner contends that the petitioner was advised bed-rest on account of an accident and was bed-ridden for four months and, hence, could not attend the classes in the 3rd semester of the B.Com (Computer) course, to which he had been admitted in the 3rd respondent-College. The petitioner has filed an application as per Exhibit P2, seeking condonation of attendance.

The learned Standing Counsel appearing for the University would contend that at first the application itself has to be recommended by the Principal, which obviously has not been done in the case of the petitioner. It is also submitted that the continuation of attendance shortage could only be on medical grounds, that too only to an extent of 10%. The minimum attendance required is 75% and the attendance shortage could be condoned upto 65%.

3. In the case of the petitioner, the petitioner is seeking condonation of attendance shortage of four months in a semester extending to six months. The petitioner had been absent for four months, since he was bed-ridden. Only for the unfortunate circumstance in which the petitioner was put, he was prevented from attending the course. However, the regulation provide for condonation of attendance only upto 10%. In such circumstance, no condonation can be granted to the petitioner and there would be no purpose served in directing the Vice-Chancellor to consider Exhibit P2 request for condonation of attendance.
In the above circumstances, the writ petition would stand dismissed.
