THE HON’BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON’BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 10567 of 2008 ORDER: (Per the Hon’ble The Chief Justice Sri Kalyan Jyoti Sengupta) Learned counsel for the petitioner seeks an adjournment for filing affidavit in reply. Having regard to the statements and averments made in the counter affidavit we are of the view that no affidavit in reply is required.
In the counter affidavit the Government has stated that some of the lands in question are patta lands and are being enjoyed by the respective pattadars as has been verified and enquired by the Tahsildar basing on the revenue records and some of the lands are classified as poramboke and Government lands and the same were assigned.
In view of the aforesaid statement we feel that no orders can be passed by this Court as prayed for in this writ petition.
The writ petition is accordingly dismissed. No order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand dismissed.
