JUDGMENT / ORDER

1. Mr.P.S.
Champaneri, learned advocate for the petitioner, submits that he may be permitted to correct the date on the typed copy of the document annexed at Page-39, as the date given on the document has been wrongly typed.
2. Permission to do, is granted. The necessary correction be carried out, forthwith.
3. Mr.P.S.
Champaneri, learned advocate for the petitioner, states that he may be permitted to withdraw the petition with liberty to approach the Collector in case the auction that is to be held on 23.01.2012 is cancelled for any reason and appropriate direction be given to the Collector to consider the case of the petitioner. In the eventuality that the petitioner approaches him.
4. Upon the above statement being made by the learned advocate for the petitioner, the following order is passed:
The petitioner is at liberty to approach the Collector, Junagadh for redressal of its grievances regarding auction scheduled to be held on 23.01.2012. In the event that the petitioner approaches the Collector, Junagadh, the Collector shall consider and decide the grievance of the petitioner, in accordance with law.
5. Subject to the above directions, permission to withdraw the petition, is granted. The petition is disposed of, as withdrawn, without entering into the merits of the case.
Direct Service of this order, is permitted.
