Heard Sri Brijesh Sahai, learned counsel for the applicant assisted by Sri Bhavya Sahai and Sri I.P. Srivastava, learned A.G.A. for the State and perused the record.
It has been contended by the learned counsel for the applicant that the case of the applicant is identical to that of the co- accused, Kunj Vijay singh @ Pappu singh who has already been enlarged on bail on 6.9.2017 vide Criminal Misc. Bail Application No. 30502 of 2017 and the applicant is also entitled to be released on bail. The applicant is in jail since 25.9.2017.
Learned A.G.A. have vehemently opposed the prayer for bail and submitted that so far as the applicant is concerned his case is distinguish from the case of the co-accused and also the co- accused has no criminal history while the present applicant is having criminal history of 14 cases out of which one is under Section 302 IPC to which learned counsel for the applicant submitted that the case under Section 302 IPC was lodged after the present case and also it is a cross case in which the applicant has received as many as 11 injuries.
Without expressing any opinion on the merits of the case and considering the submission advanced, I find no good ground for grant of bail to the applicant Nandan Singh involved in Case Crime No. 0731 of 2017 under Section 302, 201 I.P.C., police station Rewati, District Ballia.
Accordingly, the bail application is rejected.
However, the trial court is directed to expedite the trial of the aforesaid case and conclude the same within preferably a period of eight months from the date of production of a certified copy of this order, if, there is no legal impediment.
