Shri Tattvam Patel, learned advocate for the petitioner seeks permission to withdraw the petition with a view to take out an appropriate application on behalf of the trust before the Charity Commissioner. Permission as sought for is granted. Petition is disposed of as withdrawn.

Patel at this stage requests that the Court may observe that the Charity Commissioner may decide the application without being influenced by the order of the superior. This request is misconceived as it goes without saying that the Charity Commissioner will have to decide the application in accordance with law. Notice discharged. No costs.
